These Terms and Conditions (“Terms”) govern your use of the Wachana website (wachana.com) and all purchases, registrations, and interactions made through it. By accessing our website or placing an order, you agree to be bound by these Terms.

1. About Us

Wachana is an independent literary publisher based in Sri Lanka, operating under the tagline “Small Books, Big Stories.” We publish fiction, poetry, short stories, and literary anthologies in Sinhala and English, and offer workshops, competitions, and literary events.

2. Use of Our Website

You agree to use our website only for lawful purposes and in a manner that does not infringe the rights of, or restrict the use and enjoyment of the site by, any third party. You must not misuse our website by introducing viruses, attempting to gain unauthorised access, or engaging in any activity that could damage or impair the site.

3. Products and Services

a) Digital products

Digital products (e-books, PDFs, EPUBs) are delivered electronically via download link or email. Upon purchase, you are granted a personal, non-transferable, non-exclusive licence to read and use the content for your own private, non-commercial purposes. You may not reproduce, distribute, resell, or publicly display any digital product without our prior written permission.

b) Physical products

Physical books and printed materials are subject to availability. We make every effort to ensure product descriptions and images on our website are accurate. Minor variations in colour or appearance between the product displayed on screen and the product delivered may occur due to screen settings and printing processes.

c) Workshops and events

Workshop and event registrations are subject to availability and the specific terms stated on the event listing page. Wachana reserves the right to change facilitators, venues, dates, or content if circumstances require, with reasonable notice to registered participants.

d) Competitions

Entry to the Wachana Short Story Prize and other competitions is subject to the specific rules published for each competition cycle. By submitting an entry, you confirm that the work is your own original creation and that you grant Wachana the right to publish your story in our competition anthology if it is longlisted, shortlisted, or wins a prize.

4. Pricing and Payment

All prices on our website are listed in Sri Lankan Rupees (LKR) unless otherwise stated. Prices are inclusive of applicable taxes. We reserve the right to change prices at any time, but changes will not affect orders that have already been confirmed.

Payments are processed securely through PayHere and other payment methods as displayed at checkout, which may include Visa, MasterCard, mobile wallets (eZcash, mCash, Frimi), bank transfers, and Cash on Delivery for physical orders within Sri Lanka.

5. Order Confirmation and Delivery

An order is confirmed only when you receive an order confirmation email from us. For digital products, download links are typically delivered within minutes of payment confirmation. For physical products, we aim to dispatch orders within 3–5 business days. Delivery times depend on Sri Lanka Post or the courier service used and are estimates, not guarantees.

6. Intellectual Property

All content on the Wachana website — including but not limited to text, images, logos, book covers, design elements, and digital products — is the intellectual property of Wachana or its authors and is protected by copyright law. You may not copy, reproduce, distribute, or create derivative works from any content on our website without our prior written permission.

The literary works published by Wachana remain the intellectual property of their respective authors. Publication by Wachana does not transfer copyright ownership from the author to the publisher unless explicitly stated in a separate publishing agreement.

7. User Content and Submissions

By submitting content to Wachana — including but not limited to competition entries, open submissions, reviews, or feedback — you represent that the content is your own original work and does not infringe any third party’s intellectual property rights. You grant Wachana a non-exclusive right to use submitted content for the purposes described at the time of submission (e.g. publication in a competition anthology).

8. Limitation of Liability

To the fullest extent permitted by law, Wachana shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our website or the purchase of our products and services. Our total liability for any claim arising from a purchase shall not exceed the amount you paid for that specific product or service.

We do not guarantee that our website will be available at all times or free from errors, viruses, or interruptions. We are not responsible for any loss of data or damage to your device resulting from your use of our website.

9. Cancellations and Refunds

Cancellations and refunds are governed by our Refund Policy, which is available on our website and forms part of these Terms.

10. Links to Third-Party Websites

Our website may contain links to external websites operated by third parties. We have no control over and accept no responsibility for the content, privacy policies, or practices of any third-party websites.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Sri Lanka. Any disputes arising from or related to these Terms or your use of our website shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.

12. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated “Last updated” date. Your continued use of our website after changes are posted constitutes your acceptance of the revised Terms.
